Animee - Terms of Service

Welcome to Animee, a mobile application developed and operated by Anime.com Inc. (“we,” or “us”). These Terms of Service (“Terms”) govern your use of the Animee app (the “App”).

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement.

2. Your Use of the App

The App allows you to create and customize anime-style avatars and use them for personal entertainment. You may export avatars to messaging or social apps, subject to their respective terms.

You may use the App only for lawful purposes and in accordance with these Terms. You agree not to:

Use the App to create content that is illegal, hateful, defamatory, or infringing;
Interfere with or disrupt the integrity or performance of the App;
Attempt to reverse engineer, decompile, or otherwise gain unauthorized access to the App;
Use the App in violation of any applicable law or regulation.

3. Intellectual Property

All intellectual property rights in the App, including designs, graphics, code, and original avatar templates, are owned by Azuki or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use only.

4. User-Generated Content

The avatars you create using the App are considered “User-Generated Content.” You retain ownership of your avatars but grant Azuki a non-exclusive, royalty-free, worldwide license to use, display, and share such content for purposes related to improving and promoting the App.

We do not claim ownership over your individual customizations but may use anonymized, aggregated avatar data to improve functionality.

5. Data Collection and Privacy

We do not collect personally identifiable information such as your name, email, or phone number. However, we do collect:

App usage and interaction data
Device-level identifiers (e.g., IDFA)
Diagnostic data (e.g., crash logs)
Advertising performance data

Some of this data may be collected by integrated third-party services, including the Facebook Ads SDK, which may collect information such as device identifiers, coarse location, IP address, and advertising engagement data. These third-party services may associate this data with user profiles maintained by them (e.g., Facebook accounts) pursuant to their own privacy policies.

6. Disclaimer of Warranties

The App is provided on an "as-is" and "as-available" basis. We do not guarantee that the App will be error-free or uninterrupted.

The avatars you generate are intended for entertainment purposes only. We are not responsible for how these avatars are used or interpreted in third-party platforms or social contexts.

7. Limitation of Liability

To the maximum extent permitted by law, Azuki shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App.

8. Export Controls

You may not use or export the App in violation of U.S. export laws or regulations. The App may not be downloaded or used in any country subject to U.S. government embargo or sanctions.

9. Modifications

We may update these Terms from time to time. If we make material changes, we will notify you by updating the “Effective Date” above and providing in-app notice or a website update. Your continued use of the App after any update constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.

11. Apple-Specific Terms

If you downloaded the App from the Apple App Store:

These Terms are between you and Azuki Labs Inc., not Apple Inc.
Apple has no responsibility for the App or its content
If the App fails to conform to any warranty, you may notify Apple and Apple will refund the purchase price (if applicable); to the maximum extent permitted by law, Apple will have no other warranty obligation
Apple is not responsible for maintenance or support
Apple and its subsidiaries are third-party beneficiaries of these Terms, and may enforce them against you
